1. Agreement
These Terms of Service ("Terms") govern your use of the BotCruncher platform and services provided at botcruncher.com ("Service"), operated by Botcruncher.com, a sole trader (enskild firma) registered in Sweden ("we", "us", "our").
By creating an account or installing the BotCruncher snippet on your website, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. If you use the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Account registration
- You must provide accurate and complete registration information.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at [email protected] if you suspect unauthorized access to your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. The Service
BotCruncher provides:
- A JavaScript snippet that collects behavioural signals from website visitors
- Real-time bot detection and scoring using machine learning and heuristics
- Dashboard analytics showing bot traffic, ad fraud estimates, and AI crawler activity
- IP exclusion list exports for ad platform fraud prevention
- AI crawler identification and monitoring
Bot scores, fraud estimates, and traffic classifications are provided on a best-effort basis. We do not guarantee 100% detection accuracy. The estimated monetary waste figures are approximations based on industry-average cost-per-click values and should not be relied upon as exact financial calculations.
5. Acceptable use
You agree NOT to:
- Install the snippet on websites you do not own or have authorization to manage
- Use the Service to collect personal data beyond what is described in our Privacy Policy
- Reverse-engineer, decompile, or attempt to extract the source code of the snippet or API
- Use the Service to facilitate, conceal, or aid fraudulent activity
- Exceed your plan's visit limits through artificial inflation
- Resell, redistribute, or sublicense access to the Service without our written consent
- Use the Service in any manner that violates applicable laws or regulations
- Attempt to interfere with, compromise, or disable the Service's infrastructure
6. Plans and pricing
- Free plan: Up to 5,000 visits/month, 7-day data retention. No payment required.
- Paid plans: Billed monthly via Stripe. Prices are listed in EUR and include applicable VAT where required.
- We reserve the right to change pricing with 30 days' written notice to active subscribers.
- Exceeding your plan's visit limit may result in data collection pausing until the next billing cycle or an upgrade.
7. Cancellation and refunds
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- No refunds are provided for partial billing periods.
- Upon cancellation, your data will be retained according to your plan's retention period, after which it is automatically deleted.
- You may request immediate deletion of all your data at any time by emailing [email protected].
8. Data and privacy
Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms.
For website owners: By installing the BotCruncher snippet, you represent that you have a lawful basis for collecting visitor data for bot detection purposes and that your own privacy policy adequately discloses this data collection. You remain the data controller for your visitors' data; BotCruncher acts as your data processor.
A Data Processing Agreement (DPA) is available at botcruncher.com/dpa and forms part of these Terms. The DPA governs BotCruncher's obligations as a data processor when processing visitor data on your behalf.
You may delete your account and all associated data at any time from Settings > Data Rights in the dashboard.
All data is stored and processed within the European Union (Hetzner, Germany). We do not transfer data outside the EU.
9. Intellectual property
- The BotCruncher platform, including the snippet code, API, algorithms, and dashboard, is owned by us and protected by intellectual property laws.
- We grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes during the term of your subscription.
- You retain ownership of your website content. We claim no ownership rights over your data.
10. Service availability
We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance with reasonable advance notice. We are not liable for downtime caused by factors outside our control, including but not limited to third-party service outages, DDoS attacks, or force majeure events.
11. Limitation of liability
To the maximum extent permitted by Swedish law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We do not warrant that bot detection will be 100% accurate or that all fraudulent traffic will be identified.
- Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data loss.
- Monetary waste estimates are approximations and should not be used as the sole basis for financial decisions.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Termination
We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Sections 9, 11, 12, and 14 survive termination.
14. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved by the courts of Sweden.
If you are a consumer within the EU, nothing in these Terms affects your rights under mandatory consumer protection legislation in your country of residence.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
